This Terms and Condition for Use of LeadGlint website (a SaaS product of Impeccable Software's Private Limited) is a legal agreement (Agreement) between you and Impeccable Software's Private Limited , a Private Limited company incorporated in Pune, India, (hereinafter referred to as 'Impeccable Software's Pvt. Ltd. & LeadGlint', 'Our', 'Us', 'We') providing, among other things, the terms and conditions for your use of subscription services, primarily a web based LeadGlint products hosted and managed remotely (the ‘Products’, 'Services' or 'Website services') through the website located at LeadGlint. The site LeadGlint is owned and operated by Impeccable Software's Private Limited.
Read the Terms and Conditions carefully. Your use of Product OR Services on the Website means you are consenting to these Terms and Conditions. You could archive the copy of this Agreement for your records.
These Terms and Conditions may be modified from time to time in Impeccable Software's Pvt. Ltd. & LeadGlint sole discretion and you may not be notified. It is your responsibility to review these Terms and Conditions from time to time. You will be deemed to have accepted the Agreement as amended if you continue to use any of the Website products or services after any amendments are posted on the Website. We reserve the right to include additional terms and conditions if we were to provide additional products, services or programs. You shall be bound by the same on your participation in such services or programs.
Authorised Users
You represent that you have read and understood, and that you agree to be bound by this Agreement. The Website services are available to legal entities or individuals aged 18 years or older. By using the Website you represent that you are at least 18 years old.
Registration
To use the Website products or services, you may have to be registered and provide your name, valid email address, contact number and other details. Please see our Privacy Policy and practices at LeadGlint/privacy-policy on how the personal information would be used.
Account Security
You are solely responsible for the confidentiality of any password and other account information that you create in order to access or use the Products or Services. You agree to notify us immediately on any unauthorized use of your account, user name, or password. You also agree that we are not liable in any manner for any loss that you may incur as a result of any third party using your password, either with or without your knowledge. You are solely liable for any losses incurred by Us, Our affiliates, officers, directors, employees, consultants, agents, and representatives due to misuse of your account or password. Log-in to your account shall be used by one person. Multiple people are not permitted to share the same/single log-in.
Technical and content-related limitations
1. LeadGlint excludes its liability for any delays in Service operation due to circumstances beyond his control, these being in particular delays resulting from technical problems of the Internet network or telecommunications links and thus no availability or applicability parameters can be guaranteed.
2. LeadGlint excludes his liability for:
a. any damage related to third party interference, faulty operation of external factors or other systems (e.g. telecommunications grids) beyond the LeadGlint control,
b. any damage resulting from the occurrence of force majeure,
c. any damage resulting from unauthorized access to the users/clients/customers/partners/dealers/agents Account or Profile resulting from your negligence,
d. any damage resulting from the users/clients/customers/partners/dealers/agents failure to observe these Terms of Use,
e. any damage resulting from incorrect transfer of data within the system, incorrect record or receipt of messages as well as any loss of data contained in transferred messages,
f. damage to the users/clients/customers/partners/dealers/agents resulting from risk factors characteristic of the Internet, including system attacks or the users/clients/customers/partners/dealers/agents system becoming infected with malicious software.
3. LeadGlint reserves the right to:
a. periodically disrupt the availability of the Service for the purpose of its expansion or maintenance,
b. immediately terminate the provision of services should the users/clients/customers/partners/dealers/agents breach these Terms of Use,
c. change Account or users/clients/customers/partners/dealers/agents Profile parameters, including Service features and functionalities,
d. terminate provision of services at any time, by closing the entire Service or any of its parts, subject to prior placement of relevant notification on the Service website.
4. LeadGlint makes every effort to ensure that the usage of services is available for users/clients/customers/partners/dealers/agents of all most popular web browsers, operational systems, types of computers and types of Internet connections. However, LeadGlint does not guarantee and is not responsible for the successful usage of each possible combination of these options and/or LeadGlint system. The minimum technical requirements (notwithstanding any information provided in the previous sentence) which enable using services and/or LeadGlint system are as follows: access to the Internet, modern web browser which supports HTML5, CSS3 and JavaScript (suggested web browsers: Chrome 74, Firefox 65, Edge 44 and the newest versions of the all mentioned here).
Fees for the use of the system
- The user shall be charged for the licence fee appropriate to the chosen package, payment will be made by either wire transfer or using PayPal.
- Once the plan is selected and services being integrated users/clients/customers/partners/dealers/agents cannot cancel their subscription. In case of cancellation in certain conditions LeadGlint reserve full rights to deduct any fees, tax amount, integration charges etc from the money paid by users/clients/customers/partners/dealers/agents.
Final provisions
- By confirming these Terms and Conditions, the User concludes a permanent contract for an unspecified period of time with one-month notice period.
- Any matters outside the scope of these Terms of Use shall be subject to relevant provisions of the Indian law.
- With regard to any disputes arising in connection with the Service, the parties undertake to resolve any such disputes amicably, in good faith and with due respect to the interests of the other Party.
- LeadGlint users/clients/customers/partners/dealers/agents are required to keep track of any changes to these Terms of Use available at www.leadglint.com users/clients/customers/partners/dealers/agents of the LeadGlint declare that they will not use LeadGlint in a way that could constitute violation of generally accepted norms and rules of social coexistence.
